Absenteeism: key considerations for employers

Sickness absence is a tricky issue that every employer and employee will face sooner or later. It's a complicated matter: you need to comply with specific laws and regulations, and you will often have to work with an occupational health service for absence management. Sickness absence: key considerations for employers

Perhaps you're stuck with one or more of the following questions:

The Working Conditions Act requires companies to seek professional support for their health and sickness absence policies. This can be provided either by an occupational health specialist (the so-called bespoke scheme (maatwerkregeling), where the employer chooses the expert under certain conditions) or by a certified occupational health service.

Occupational health service

If you engage an occupational health service, this is called a ‘safety net scheme’. You sign a contract with a certified provider, whose tasks include:

  • reviewing the Risk Inventory & Evaluation (RI&E),
  • providing expert guidance during illness,
  • offering (periodic) occupational health checks (PAGO),
  • carrying out pre-employment medical examinations if needed,
  • offering employees the option of a preventive consultation with the occupational physician.

The Eligibility for Permanent Incapacity Benefit (Restrictions) Act

Under the Eligibility for Permanent Incapacity Benefit (Restrictions) Act, employers and employees must follow certain steps during long-term absence. The Employee Insurance Agency (UWV) will assess compliance when a WIA disability benefit is applied for, based on the reintegration report (RIV test). If obligations haven’t been met, the UWV can impose sanctions, for instance, requiring the employer to continue wage payments for another year.
