We respect your privacy. This privacy statement applies to all personal data collected or used by de Jong & Laan Beheer B.V. and its (subsidiary) companies (de Jong & Laan), to the extent that they act as a ‘data controller’ within the meaning of the GDPR. De Jong & Laan complies with all applicable data protection laws and regulations and takes appropriate measures to prevent misuse, loss, unauthorised access, and other unwanted actions involving your personal data.

DATA SUBJECTS

This privacy statement applies to all individuals whose personal data is processed by de Jong & Laan in its capacity as data controller (referred to as data subjects), excluding employees of de Jong & Laan. Therefore, this statement applies in any case to (employees of) clients and (sub)contractors of de Jong & Laan, (employees, clients, and other contacts of) prospective clients, and other relations of de Jong & Laan, visitors to the website, and recipients of newsletters or other (commercial) emails from de Jong & Laan. It also applies to former individuals in the aforementioned categories.

CATEGORIES OF PERSONAL DATA, PURPOSES, AND SOURCES

We only process personal data that you, your employer, your debtor or creditor, or other (official) bodies such as the Tax Administration or the Chamber of Commerce have provided to us. We also process personal data that we can derive from your visit to our website.

We process the following categories of personal data:

- Contact details, salary information, personal data in (financial) records, (email) correspondence, and other personal data necessary for de Jong & Laan to carry out its services properly;

- Contact details you have initially provided verbally, including data on business cards;

- Contact details and other personal data submitted via the contact form on our website;

- Personal data obtained through or generated by our website, electronic newsletters, commercial emails, or related technologies such as your IP address and browsing behaviour on the website. This includes data about your first, previous, and current visits, pages viewed, and how you navigate through the website;

- Whether you open a newsletter or commercial email and which elements you click on;

- Personal data obtained from other sources, such as publicly available personal data on social media platforms like LinkedIn, from the Trade Register of the Chamber of Commerce, from the Land Registry (Kadaster), and from public (business) websites.

We acknowledge our responsibility to safeguard the personal data you entrust to us. This is reflected in our ISO 27001 certification (Information Security Management). De Jong & Laan uses various technologies to protect your data, including secure servers and firewalls.

LEGAL BASIS

We process personal data on the basis of one of the following legal grounds (as listed in Article 6 of the GDPR):

Consent
- If you have given your consent, we are permitted to process your personal data. For example, this may include sending newsletters if you are not yet a client. You have the right to withdraw previously given consent at any time.

Contractual necessity

- If you engage us to provide accountancy or consultancy services, we process personal data to the extent necessary for the performance of that contract.

Legal obligation
- De Jong & Laan is legally required to process certain personal data under, for example, the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (WWFT) and the International Assistance in the Levying of Taxes Act (WIB). This may include collecting and storing a copy of your identity document (such as a passport).

Legitimate interest
- We may also process personal data where we (or a third party) have a legitimate interest in doing so, provided that such processing does not unduly infringe on your privacy.

THIRD PARTIES

Access to your personal data is limited to our employees and to third parties who are involved in or responsible for activities related to the processing of the relevant data, or whose involvement is necessary for those activities.

As a general principle, personal data is not shared with third parties. If data is shared, it will only be done with your explicit consent, when necessary for the execution of a contract we have with you, or when required by law. In exceptional cases, we may also share data when it is of vital importance to the data subject.

Occasionally, de Jong & Laan may offer a service in collaboration with other companies as part of a joint marketing initiative. In such cases, your personal data may be shared with these companies. Please note that these companies often have their own privacy policies, which may differ from the privacy policy of de Jong & Laan. Our newsletters, emails, or websites may also contain links to third-party websites. We encourage you to read their privacy statements carefully, as they may differ from that of de Jong & Laan.

If third parties process (a portion of) data on behalf of de Jong & Laan (so-called (sub-)processors), we will enter into a (sub-)processing agreement with those parties. Moreover, de Jong & Laan only engages processors that provide sufficient guarantees and implement appropriate technical and organisational measures to ensure that your personal data is processed securely and in compliance with applicable laws and regulations. De Jong & Laan maintains a record of all (sub-)processors it engages.

The (hosting) partners with whom de Jong & Laan collaborates and who therefore (partially) have access to your personal data include VWO, Hobo Trade Holding B.V., Spotler, Trimm, Adwise, Webiteers, Facebook, X, LinkedIn, Google, and YouTube.

DATA RETENTION PERIODS

We do not retain collected personal data longer than necessary. Data for which no statutory retention period applies will be deleted once it is no longer needed for the purpose for which it was collected.

INFORMATION AND RIGHTS OF DATA SUBJECTS

You have the right to access, correct, or request the deletion of your personal data. Additionally, you may object to the processing of your data. In certain cases, you may also request that de Jong & Laan restrict the processing of your data or transfer it to you or to a third party. These rights are subject to limitations. Applicable legislation defines the circumstances under which we must or may decline such requests.

If you are dissatisfied with the way we process your personal data, you may file a complaint with our Privacy Officer. If your complaint cannot be resolved, you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
