Self-employed professionals
Self-employed professionals
Working with self-employed professionals often raises questions, such as:
- What should I do if an employee wants to continue as a self-employed professional?
- How can I assess whether a contractor is truly self-employed?
- Which type of agreement should I use?
- How should I structure arrangements with a self-employed professional?
Currently, the Assessment of Employment Relationships (Deregulation) Act (Wet DBA) is still in effect, but its implementation has caused a lot of uncertainty and ambiguity. Enforcement of this legislation has been postponed several times.
A new perspective on self-employed professionals
There is ongoing discussion about taking a new perspective on self-employed professionals, focusing on three key changes:
- A more level playing field in terms of taxes and social security
- Greater clarity around the concept of “working for”
- Stronger enforcement
We’re happy to keep you informed of how this develops.
Self-employed professionals and the labour market: opportunity or risk?
The number of self-employed professionals is growing rapidly because of their flexibility and expertise. Yet working with self-employed professionals comes with risks. Stricter rules and the end of the enforcement moratorium call for companies to critically assess or reassess their partnerships with self-employed professionals.
